Terms of service

These terms apply to every service I provide. If your written proposal or agreement says something different, the proposal or agreement takes priority for that point.
1. Who I am
Services are provided by Andrew Simon Hunter, a sole trader trading as Andy Hunter, based in Gibraltar and licensed by the Office of Fair Trading under business licence BL231875. Contact: andy@andyhunter.gi.
2. What I provide
Business consultancy and done-for-you systems for hospitality venues and property businesses. The packages and prices are listed on the Hospitality Systems and Property Systems pages. Exactly what's included for you, your start date and any setup work are set out in your written proposal.
For property businesses I supply systems and non-personal market data only. I don't act as an estate agent, sell or pass on leads, make introductions between buyers and sellers, or hold or handle client money.
3. Fees and payment
- All prices are in pounds sterling (GBP). Gibraltar has no VAT, so no VAT is added.
- Any setup fee is payable when you accept the proposal, before setup work starts.
- The monthly fee is charged in advance, by card through Stripe, on the same date each month from your start date.
- If a payment fails, I'll let you know and retry. If it's still unpaid 14 days later, I may pause the service until it's paid.
- If you go past a package's included volume, extra work is charged at the rate agreed in your proposal, up to the monthly ceiling you set.
- I'll give you at least 30 days' written notice of any price change. Prices don't change during a minimum term.
4. Minimum terms
- Hospitality add-ons (Reviews, Back Office, Partner) are month to month, with no minimum term. Partner includes a website, which has the 12-month minimum below.
- Websites (Website & Bookings, and Presence for property businesses) have a 12-month minimum term, then continue month to month.
- Property add-ons (Enquiry desk, Market tracker) are month to month, alongside a Presence website.
5. Cancellation
- To cancel, email andy@andyhunter.gi. I'll confirm in writing.
- Month-to-month services: you can cancel at any time. The service runs to the end of the month you've already paid for, and you won't be charged again.
- Services with a 12-month minimum: you can cancel at any time after the minimum term, on the same basis. If you cancel during the minimum term, the monthly fees for the rest of that term are still due, unless we agree otherwise in writing.
- I can end a service with 30 days' written notice. In that case you only pay up to the end date, and you get a pro-rata refund of anything paid for the time after it.
6. Refunds
- Setup fees: refunded in full if you cancel before setup work has started. Once work has started, the setup fee is non-refundable, because it pays for work done specifically for you.
- Monthly fees: a month that has already started isn't refunded, but you won't be charged for any month after you cancel.
- Mistakes: any duplicate or incorrect charge is refunded in full as soon as it's spotted.
- If I don't deliver: if I fail to provide a service you've paid for and don't put it right within 14 days of you telling me, I'll refund the fees for the affected period.
- Refunds go back to the card used to pay, usually within 5 to 10 working days.
7. Your data and your accounts
Your website domain, content, customer records and business data stay yours. They're kept separate from every other client's, and I'll export them to you in full whenever you ask, including when you leave. I only use your data to provide the service to you. The privacy notice explains how personal data is handled.
You give me access to the accounts the service needs (for example Google Business Profile, Xero or your booking system), and you can remove that access at any time. If you do, the parts of the service that depend on it will stop.
8. Third-party platforms
Some services rely on platforms run by other companies, such as Google, Tripadvisor, Xero and Stripe. I'm not responsible for their outages, policy changes or decisions about your accounts. If a change stops part of a service working, I'll tell you and work out an alternative with you. Where a platform has no reply interface (for example Tripadvisor), replies are drafted for you to approve and post.
9. Liability
I'll provide the services with reasonable skill and care. My total liability under any agreement is limited to the fees you paid in the three months before the claim. I'm not liable for indirect losses such as lost profit or lost business. Nothing in these terms limits liability that can't be limited by law.
10. Changes to these terms
If I change these terms, I'll give existing clients 30 days' notice by email. Changes don't apply to a minimum term that's already running unless you agree to them.
11. Law
These terms are governed by the laws of Gibraltar, and the courts of Gibraltar have jurisdiction.
